Amy Foerster is co-chair of the Higher Education Practice and a member of the Commercial Litigation and Labor, Employment and Employee Benefits practices.
Amy serves clients in a broad spectrum of litigation matters. On the commercial front, she represents clients in complex contract, healthcare reimbursement, construction and other litigation in state and federal courts, as well as before arbitrating bodies and administrative agencies. On the employment front, Amy represents employers in litigation involving non-compete, wage payment, discrimination, whistleblower, and wrongful discharge claims, as well as other employment disputes. She represents management in labor arbitrations and counsels clients regarding an array of employment issues impacting employers on a day-to-day basis.
As co-chair of the Higher Education Practice, Amy provides legal services to colleges, universities, community colleges and career training schools. Building on her prior employment with the Pennsylvania Department of Education and Pennsylvania Office of Attorney General, Amy advises clients on many issues impacting institutions of higher education, including Title IX (sexual misconduct), student discipline and codes, policy preparation and implementation, Title IV federal student aid, information security, and a plethora of other compliance-related matters. She also counsels institutions of higher education regarding employment issues, including hiring, firing, and charges of discrimination, as well as tenure disputes. She is frequently asked to speak and write about higher education compliance issues on a national level.
Prior to joining Saul Ewing, Amy was a senior deputy attorney general with the Civil Litigation Section of the Pennsylvania Office of Attorney General, where she defended the Commonwealth of Pennsylvania against lawsuits challenging the constitutionality and legality of its policies, programs and employment practices. Her employment litigation experience in that capacity includes defending against claims brought under the First Amendment, Title VII, Title IX, the Equal Pay Act, and the Family Medical Leave Act. Amy was also the Office of Attorney General's point person for the implementation of the 2006 amendments to the Federal Rules of Civil Procedure regarding electronic discovery. Prior to joining the Office of Attorney General, Amy was with the Pennsylvania Department of Education's Office of Chief Counsel, serving as primary counsel to the Office of Postsecondary and Higher Education. Amy started her career as an attorney with a Harrisburg-based medical malpractice insurance defense law firm, where she represented physicians and medical institutions in every phase of litigation.
Amy is admitted to practice before the Third Circuit Court of Appeals, as well as the United States District Courts for the Middle District, Eastern District, and Western District of Pennsylvania.
