Brian Kowalski serves as bond counsel, underwriter's counsel and trustee's counsel on various tax-exempt financings for municipal, water and sewer, healthcare, transportation, economic development, solid waste, higher education, housing and redevelopment projects. He handles transactions for both new money and refunding projects, pooled transactions and transactions that have utilized various types of credit enhancement such as bond insurance, letters of credit and guarantees. Brian also represents municipalities on redevelopment project and the authorization of PILOT bonds to finance related infrastructure improvements.

Brian also has extensive experience in the areas of energy law and state, local and municipal law. 

Experience

Serving as co-bond counsel to a state turnpike authority in connection with the issuance of $2,428,990,000 Turnpike Revenue Bonds which were issued as part of a plan to combine the turnpike authority and a highway authority into a single entity to produce financial savings, to obtain efficiencies in administration, management and operations, to permit a pooling of economic resources to fund capital projects and to implement a coordinated transportation plan

Serving as underwriter’s counsel for the sale by a state economic development authority of $1,606,185,000 School Facilities Construction Bonds which were issued to finance school facility projects being undertaken by, or for the benefit of, school districts throughout the state

Representing a county improvement authority with the creation of a county-wide energy conservation program including the preparation of shared services program for the preparation of Energy Savings Plan and NJBPA-approved energy audits, and the financing of energy conservation projects through a Green Energy Lease Bank

Representing a municipality with the negotiation of a Project Development Agreement and Financial Agreements for a multi-use Redevelopment Project, including the negotiation and authorization of related infrastructure funding with PILOT bonds
