Don Rea is a partner in the Litigation Practice whose practice concentrates on construction and real estate disputes and class actions for clients including owners, developers and contractors of retail, commercial and industrial properties. His class action experience focuses on providers of consumer financial services.
Two of the hallmarks of Don's practice are a keen awareness of the budgetary constraints facing his clients and his concentration on finding the most effective business solutions to their disputes.
Don was instrumental in establishing and implementing the Maryland Business and Technology Case Management Program, which provides specially assigned judges and distinct litigation tracks for business and technology lawsuits in Maryland’s circuit courts. He serves as a faculty member of the Maryland Judicial Institute, instructing Maryland judges on various business and technology issues. Formerly, he chaired the Maryland State Bar Association's Technology Committee and several ABA subcommittees, including the Lender Liability Subcommittee of the Commercial and Business Litigation Committee.
Experience
Some of his more recent trial experience includes:
- Representing a manufacturer of construction materials in $55 million breach of contract, negligence and fraud claims against it that resulted in successful verdict for the client
- Representing a multinational retailer in $25 million bench trial for breach of commercial lease case resulting in partial summary judgment for the defense
- Representing a national bank in $16 million jury trial for breach of commercial loan contracts and fraud, resulting in a successful verdict for the defense
- Multi-district litigation on behalf of national retail organization against builder of approximately one dozen stores in four states, involving mechanic’s liens, construction defect and incomplete project claims and approximately $30 million in overall construction claims, resulting in favorable judgments and subsequent settlements for client and coordinated replacement contractors and suppliers
- Multiple arbitrations of construction defect, scheduling and materials cases ranging from $500,000 to approximately $15 million, resulting in successful defense awards for owners, developers and contractors
- Successful defense of national bank and mortgage corporations in multi-million dollar consumer financial services class actions involving truth-in-lending, settlement services, broker compensation and other issues
- Bench trials resulting in successful verdicts for leasing organizations, mortgage corporations, developers and contractors
