Doreen Zankowski focuses her practice on construction, engineering, business, real estate development, and environmental law. She counsels clients by giving them practical and efficient advice to advance their project through the often daunting legal and regulatory hurdles to success. She advises clients on vertical construction projects, heavy highway public works projects, water and wastewater facilities, solid waste programs, power, airport, ports and marine facilities, green construction projects, schools and universities, hospitals and skilled nursing programs. She brings hands-on experience to the transactional side of the business – focusing on risk management; contract drafting; contract review and negotiation using various project delivery methods, such as integrated project delivery for both public and private works. She is familiar with the multiplicity of contractual arrangements and business structures for public-private partnerships. On the claims side, Doreen advises clients on claims development, analysis, defense and prosecution. She understands that time and contractual concerns dictate successful results. She has experience in delay, acceleration, and loss of productivity claims.
Experience
Doreen's construction law representative matters include, but are not limited, to:
- Representing a major hospital in numerous construction projects relating to new and rehabilitation/renovation facilities work
- Representing a general contractor on a Massachusetts Highway Department, “Smart Highway System and Electrical Construction” project as part of Boston's engineering successful “Big Dig” project that buried the city of Boston's infrastructure and improved the infrastructure of a thriving city
- Represented a private electrical, construction, and WI/FI contractor on the installation of the Massachusetts Highway Department's roads, bridges and tunnels program
- Represented a design/build contractor on the Detroit, MI - Waterworks Park Design/Build Project
- Represented a design/build contractor on the Detroit, MI - Instrumentation and Control Design/Build Project
- Presented a design/build/operations contractor on the Milwaukee, WI - Water Treatment Plant D/B/O Project
- Represented a design/build contractor on the Glendale, CA - Water Treatment and Infrastructure Remediation Project – turning contaminated groundwater into drinking water
- Represented the Owner and Developer on the Seattle, WA - Tolt Treatment Facilities, design/build/finance/operate/maintain program

- Represented the owners of a quarry, concrete manufacturing, asphalt plant facilities against claims by State and Federal regulatory agencies for contamination and claims of Clean Water Act violations
- Represented the design/build contractor on the Massachusetts Water Resources Authority, MA - Norumbega Design/Build Project
- Represented the developer and design/build contractor on the Massachusetts Highway Department, Route 3 Development Project – Design/Build/Maintain
- Serving as an arbitrator in a complex large construction and environmental matter, involving the State of New York, an international design/build contractor, and a ENR-top ranked design firm, with an amount in dispute of $120 million
- Representing one of the world's largest property casualty insurers in the design and construction of a $110 million one-of-a-kind testing facility, completed on a design-build basis, and utilizing unique insurance products to control project risks
Litigation Representative Matters
- Successful prosecution of affirmative claims and defense against counterclaims in a $250 million dispute on Boston's Big Dig electrical and smart highway systems program
- Successful defense of a major school district in a $35 million delay and active interference claim of a general contractor involving two construction projects totaling $110 million
- Represented an owner in defaulting and terminating a general contractor and obtaining $28 million in performance and payment bond payments to successfully complete an educational facility
- Successful defense of an international construction company against claims and liens in excess of $30 million by an EPC-mechanical subcontractor for two major power plant projects in NY and PA
- Obtained a $1.4 million builder's risk payment relating to damages to a ground freezing system for tunnel jacking operations
- On behalf of an owner, prosecuted an environmental contribution claim and obtained a declaratory judgment against a Fortune 50 company for a contaminated property in Massachusetts
- Successful negotiation of several Administrative Consent Orders on behalf of owners, general contractors, and PRPs with State and Federal regulatory agencies (EPA, MassDEP, DOJ)
- Drafted and negotiated several EPC power contracts for plants in NY
