Will DuBois represents utility, merchant generator, and oil and gas industry clients on energy, environmental, and administrative law issues before the Public Service Commission of Maryland (PSC), Maryland Department of the Environment, U.S. Environmental Protection Agency, and other federal and state administrative bodies. Will is a partner in the Firm’s Energy and Utility and Environment and Natural Resources practices, resident in the Baltimore, Maryland office.
Will brings to clients extensive experience in the permitting and licensing of new electric generating stations, new transmission lines and modifications to existing facilities. He routinely advises clients on a wide range of environmental issues related to new and existing energy facilities, including refineries, and has particular experience in issues under the Clean Air Act and associated federal and state regulations. He is a frequent speaker on air regulatory issues, including the regulation of greenhouse gases.
Experience
Will appears before the PSC on behalf of utility and other clients. Recent significant matters include:
- Representation of two national energy companies in their application to obtain authorization to exercise substantial influence over Maryland’s largest gas and electric utility company as a consequence of their merger
- Representation of a merchant generator in obtaining a Certificate of Public Convenience and Necessity for a fuel switch project at an existing coal facility, including permitting as a major modification under the Prevention of Significant Deterioration air permitting program
- Representation of a merchant generator in obtaining a Certificate of Public Convenience and Necessity for the development of a new natural gas-fired generating station
Will is active in issues of public education, particularly with respect to Maryland public charter schools. He has successfully represented nonprofit education entities in a variety of matters including:
- Administrative litigation that resulted in a significant increase in funding available to Maryland charter schools, followed by a successful defense of the decision on judicial review in the Maryland Court of Appeals and Maryland Court of Special Appeals
- Negotiation of model charter school agreements in Baltimore City and individual charter agreements in St. Mary’s County and Frederick County
- Administrative litigation that resulted in an elimination of the cap on the number of Baltimore City public charter schools
