Randy Lutz brings to Saul Ewing more than three decades of extensive experience in environmental law. He focuses his practice in brownfield redevelopments; utility development projects, including expansions and counseling clients on compliance with state and federal environmental regulations; litigation of environmental claims; and environmental enforcement defense. He has substantial experience in the oil and gas industry.
Prior to reentering private practice in 1987, Randy served in various public positions, including working for the U.S. Environmental Protection Agency (EPA) and the state of Maryland’s Attorney General's Office where he was Principal Counsel to the Department of Health and Mental Hygiene, which included the environmental regulatory programs at that time.
As former Director of the EPA's criminal enforcement program, Randy was responsible for helping to establish the environmental criminal enforcement program at the EPA. He reviewed and approved all criminal investigations and referrals for prosecution, and developed national policies and priorities with respect to federal enforcement. His work with the EPA earned him the EPA’s Bronze Medal for outstanding public service.
Prior to his service with the EPA, Randy served for seven years as Principal Counsel and Assistant Attorney General of the Maryland Department of Health and Mental Hygiene in Baltimore.
Randy is frequently asked to write and speak on a range of environmental and economic development issues. He has been listed as one of the Best Lawyers in America for Environmental and Natural Resources and has been recognized by Corporate Counsel as one of the top lawyers for Energy/Public Utility, Environmental and Natural Resources Law in the state of Maryland.
Randy is admitted to practice in Maryland and before the U.S. District Court for the District of Maryland, the U.S. Supreme Court and the Fourth, Third and D.C. U.S. Circuit Courts of Appeal.
Experience
Most recently, Randy has represented clients in a variety of environmental matters, including:
- A Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) cost recovery action against the former owners of a large paint plant
- A Resource Conservation and Recovery Act (RCRA) suit involving allegations of methane migrating under homes
- The redevelopment of contaminated industrial property in Baltimore City and Silver Spring, MD
- Permitting and analysis for the conversion of a shared multi-hospital waste incinerator to off-site destruction.
