Andrea P. Brockway
Andrea Brockway represents clients involved in complex commercial litigation in federal and state courts. She focuses on cases involving white collar criminal defense, particularly in the health care and pharmaceutical industries. She represents clients in the higher education industry as well. Her federal practice also includes ERISA litigation matters.
Select representations include:
- A global pharmaceutical company facing allegations from a former employee of violations of the Food, Drug and Cosmetic Act and Anti-Kickback Statute. The firm assessed its sales and promotional practices and helped design a remedial action plan. No federal investigation or whistleblower action under the False Claims Act ensued.
- An individual who was accused of acting as a “robo-signer” of mortgages for one of nation’s largest mortgage service companies. The firm convinced DOJ and several State Attorneys General not to proceed against the client.
- Assisting in the defense of a public university in civil litigation matters stemming from claims brought by alleged sexual abuse victims as well as overlapping legal proceedings, including civil and administrative matters.
- Advising institutions of higher education on regulatory interpretation questions and on policy preparation and implementation.
Andrea is also the editor of Whistleblower Wire, a blog published by the firm’s White Collar and Government Litigation Practice to provide intelligence for industry on whistleblower law.
As an enhancement to her practice before the federal bench, Andrea serves as the firm’s liaison to the Volunteer Attorney Panel for the U.S. District Court
