Brandenburg quoted in article on plan amendments and compliance deadlines
"Plan Amendments: Benefit Practitioners Ask IRS for Help With Amendments, Compliance Deadlines", BNA Pension & Benefits Daily
Dan S. Brandenburg, a partner in the Labor, Employment and Employee Benefits Practice Group, was quoted in this article in the February 8, 2011 issue of BNA Pension & Benefits Daily. The article discusses how the Internal Revenue Service is considering whether to establish a single deadline for employee benefit plans to adopt discretionary and interim amendments. Simplifying procedures for making interim amendments would help put an end to a nearly universal complaint of benefit practitioners. In addition, practitioners asked the IRS to adopt a different approach to extending deadlines for compliance with new regulations.
As to whether the IRS is going to issue guidance that is more comprehensive and complex than guidance that it issued in the past, Brandenburg said, “Employee benefits practitioners as a group seem to prefer 'definitiveness' in regulatory guidance. The more definite the answer we want, the more words it's going to take."
