Alain Baudry is an experienced trial lawyer who represents companies in high-stakes disputes involving contracts and many other types of commercial litigation, as well as in antitrust, intellectual property and securities matters. During his more than 30 years as a litigator, clients including a professional sports team, a global food producer and a privately owned printing and marketing company have relied on his ability to provide straightforward legal counsel to help them determine how to respond to claims that affect their business. Alain provides representation in state and federal courts, including bench and jury trials, as well as before arbitration panels.

Experience

Commercial Litigation

Select representations include:

A major egg-producing company in a week-long bench trial over alleged breach of an $8.9 million custom egg drier contract and claim for $3.9 million in lost profits. The U.S. District Court for the Northern District of Iowa denied the manufacturer's request for lost profits in its entirety. Argued Eighth Circuit appeal by Defendant in November 2018 and trial court ruling awarding client a refund of $2.7 million was affirmed in January 2019.
A pork processor defending against a $40 million wrongful termination claim by a former distributor. The client prevailed after a nine-day arbitration with a ruling in the client's favor on liability and an award of damages to the client in the amount of $1.9 million.
A major egg-producing company seeking recovery under a $7 million pollution policy for damages incurred as a result of an avian influenza outbreak. Obtained a favorable confidential settlement on the eve of a jury trial.
Antitrust Litigation

Select representations include:

An NBA franchise in the successful settlement of an antitrust action by season ticket holders arising from the team's adoption of an electronic ticketing platform following a successful motion in Hennepin County District Court to compel arbitration.
Intellectual Property Litigation

Select representations include:

A start-up medical device company facing accusations of misappropriating the plaintiff's trade secrets. A trial in Hennepin County District Court is expected in 2019.
An agricultural data company in a trade secret non-compete dispute.
Securities Litigation

Select representations include:

An indenture trustee on behalf of retail bondholders suing for false representations in a $35 million stadium bond financing. Obtained recoveries in excess of $10 million.
