Alain Baudry is an experienced trial lawyer who represents companies and individuals in high-stakes disputes involving contracts and many other types of commercial litigation, as well as in antitrust, intellectual property and securities matters. During his more than 30 years as a litigator, clients including a professional sports team, a medical start-up, a global food producer and a privately owned printing and marketing company have relied on his ability to provide straightforward legal counsel to help them determine how to respond to claims that affect their business. Alain provides representation in state and federal courts nationally, including bench and jury trials, as well as before arbitration panels.

Alain also recently worked alongside the Minnesota ACLU in a pro bono case involving federal civil rights litigation. In the case, they obtained a ruling that the Anoka County jail’s policy of automatically notifying ICE whenever foreign born persons were brought to the jail violated the client’s equal protection rights. A trial on damages is scheduled for November 2020 in Minnesota federal district court.

Experience

Commercial Litigation

Select representations:

Defended a major egg-producer in a week-long federal bench trial over alleged breach of a custom egg drier contract and claim for $3.9 million in lost profits. The district court awarded zero lost profits and ordered that the manufacturer refund $2.7 million to the client. The Eighth Circuit affirmed the ruling.
Represented the same client in a jury trial in Indiana federal district court and obtained a $ 1.5 million verdict for breach of a separate egg supply agreement in November 2019.
Defended a local pork processor against a $40 million wrongful termination claim by a former distributor. The client prevailed after a nine-day arbitration with a ruling that the distributor was properly terminated for cause and obtained an award in the client's favor in the amount of $1.9 million. The federal district court subsequently confirmed the award.
A major egg-producing company seeking recovery under a $7 million pollution policy for damages incurred as a result of an avian influenza outbreak. Obtained a favorable confidential settlement on the eve of a federal jury trial.
Antitrust Litigation

Select representations include:

An NBA franchise in the successful settlement of an antitrust action by season ticket holders arising from the team's adoption of an electronic ticketing platform following a successful motion in Hennepin County District Court to compel arbitration.
Intellectual Property Litigation

Select representations include:

A start-up medical device company facing accusations of misappropriating the plaintiff's trade secrets. A trial in Hennepin County District Court is expected in 2021, but obtained a $185,000 sanctions award against the plaintiff and its former counsel relating to underlying litigation misconduct following a two-day trial in November 2019.
An agricultural data company in a trade secret non-compete dispute resulting in a stipulated injunction following a five-day federal court trial in 2018 preventing a former executive from directly competing with the client.
Securities Litigation

Select representations include:

An indenture trustee on behalf of retail bondholders suing for false representations in a $35 million stadium bond financing. Obtained recoveries in excess of $10 million.
