Andrea Brockway counsels a diverse group of clients including those in the higher education, health care, and pharmaceutical industries that are facing complex commercial litigation in federal and state courts and government enforcement actions. 

Andrea's experience counseling institutions of higher education includes responding to private lawsuits as well as conducting internal fact-finding investigations. Andrea's work for institutions of higher education includes matters involving wrongful death and survival actions, hazing, sexual assault or abuse, student conduct, Title IX and other civil rights and discrimination statutes, the Clery Act and tort claims.  She also provides proactive assistance, including preparing policies and trainings on a range of issues.

Her white collar practice focuses on assisting companies and individuals being investigated by various government agencies or acting as witnesses in such cases, including conducting internal investigations and responding to subpoenas.  

Andrea also has broad experience in business disputes, and handles a wide array of general litigation matters ranging from breach of contract and tortious interference, breach of fiduciary duty, trade secret misappropriation and the federal Defend Trade Secrets Act. She also handles claims of civil conspiracy, fraud, conversion, and civil RICO issues.

As an enhancement to her practice before the federal bench, Andrea is a member of the Women’s White Collar Criminal Defense Association. She also serves as the Firm's liaison to the Prisoner Civil Rights Volunteer Attorney Panel, for the U.S. District Court for the Eastern District of Pennsylvania, where she has provided pro bono representation to prisoners in civil rights cases.

Represent universities in civil lawsuits, including cases involving claims of wrongful death and survival actions.
Assisted in the defense of a public university in civil litigation stemming from claims brought by alleged sexual abuse victims.

Select matters include:

Represent former executive of pharmaceutical company in multidistrict generic pharmaceuticals pricing antitrust litigation.
Prepared numerous pharmaceutical sales representatives for federal grand jury testimony; attend AUSA’s pretrial interview of sales representative in advance of pharmaceutical company’s criminal trial.
Commercial Litigation

Select matters include:

Defend a group of companies in a federal action involving claims of breach of contract and alleged trade secret misappropriation under the Federal Defend Trade Secrets Act.
Represented a company in a state appellate matter involving claims of fraud and civil conspiracy, conversion, and breach of fiduciary duty.
Represented insurer in ERISA litigation matters filed in federal court, addressing group benefit plans and disability insurance.
