Gary R. Clarke

Gary Clarke concentrates his practice in the area of commercial real estate development and transactions, with an emphasis on land use approvals and permitting, site acquisition and disposition, construction, and leasing matters. Gary provides real estate legal counsel to clients in the higher education, health care, multi-family residential, office, retail, hospitality and restaurant industries around the country and assists clients with major mixed-use developments and other large construction projects in Philadelphia. His experience with commercial real estate transactions consists of acquisitions, dispositions and leases for uses including student housing, hotels, shopping centers, health care centers and office buildings. He also advises clients on zoning and land use matters and obtains zoning and land use approvals for a wide variety of clients and project types, including mixed-use residential developments, office buildings, schools and restaurants.

Gary is actively involved in firm leadership and serves on the firm’s Hiring Committee. Additionally, Gary is involved in numerous community organizations and is a founding member of the Friends of Spring Garden School, a non-profit dedicated to providing support to a Philadelphia public school.

Prior to pursuing his law degree, Gary served for four years as a surface warfare officer in the U.S. Navy, stationed in San Diego, California and Norfolk, Virginia, and deployed twice to the Arabian Gulf. He attained the rank of lieutenant before being honorably discharged in 2009.

A Philadelphia-based developer in its development of major mixed-use residential apartment towers in neighborhoods across Philadelphia
An urban school district in the ground-up development of new, and major renovation of existing, public schools
A private real estate investment trust in obtaining development approvals in the renovation of a large shopping center in Philadelphia
A medical office operator in obtaining development approvals for various locations in Philadelphia
A restaurant chain in obtaining development approvals for its Philadelphia headquarters
A coffee shop chain in obtaining development approvals for various locations in Philadelphia
Commercial Real Estate Transactions

Select representations include assisting:

A private real estate investment trust in the $1.9 billion sale of 49 shopping centers located throughout the United States
A private real estate investment trust in assuming private ownership of land in order to facilitate the redevelopment of three city blocks in downtown Philadelphia. The work included providing the legal foundation to aggregate publicly and privately owned land that had been controlled by an authority to transfer these parcels to private ownership and to adjust the underlying funding arrangements involving city and state government. Overlapping issues involved eminent domain, streets, public transportation, historic protections and air rights, all regulated by government entities.
A private university on a ground lease and development agreement with a master developer for a mixed-use urban innovation district in Philadelphia designed to promote creativity, research, cooperative education, and technological advancement in a new neighborhood offering commercial office, academic, and research space, residential and hotel units, retail and restaurants, and recreational spaces
A community college in its ground lease for the development, via a public-private partnership, of a high-quality mixed-use student and market rate housing facility and related amenities located on campus
A hotel developer in ground leases for hotels located on university campuses and developed through public-private partnerships with the host institutions
An urban school district in the sale of unused buildings
