Overview

Steve Kerbaugh represents companies in employment and commercial litigation, and advises them on employment matters affecting their daily operations. Clients who look to him for advice range from closely held companies to multi-national, publicly traded corporations across the country and in an array of industries, including, but not limited to, agribusiness, energy, financial services, health care, insurance, life sciences, manufacturing, medical device and pharmaceutical.

On the litigation side of his practice, Steve represents clients in unfair competition claims, including actions involving alleged violations of restrictive covenants, tortious interference with contracts and misappropriation of trade secrets. He also focuses on defending employers and executives accused of discrimination and unfair employment practices, including wrongful termination and retaliation matters.

Steve has tried numerous cases (bench and jury) to verdict in federal and state courts, and in arbitration. Steve also represents employers before administrative agencies. He also handles appellate cases, including representations before the Minnesota Court of Appeals, the California Court of Appeals and the Eighth Circuit Court of Appeals.

His employment counseling work includes drafting and reviewing restrictive covenants, employment agreements, independent contractor agreements, commission agreements, employee handbooks and policies. Clients also rely on him for counsel on matters involving statutory and regulatory compliance issues, and employee retentions and separations.

Beyond his employment work, Steve handles business torts, including claims involving fiduciary duties, business disparagement, shareholder and partnership disputes, and fraudulent conveyance matters.
