The June 3, 2015 EB-5 Diligence “Dealing with Senior Lenders in EB-5” webinar was related to the utilization of EB-5 financing combined with senior financing and, potentially, bridge financing. This report discusses the results of my recent trip to China and the response from Chinese marketing agents regarding recent issues involving both retrogression and the so-called “Johnson Letter,” which is available below. Jeh Johnson is the Secretary of Homeland Security and has issued a position paper on behalf of Homeland Security that was forwarded to Senators Grassley and Leahy. It is difficult to predict the effect of the Johnson Letter and whether the positions taken therein are the same as the two (2) Senators of the Judiciary Committee.

At the beginning of the USCIS most recent Stakeholders' call, USCIS provided the following statistics for information purposes for the current fiscal year, which can also be accessed on the USCIS website. The statistical information included:

  1. 5,250 I-526 Petitions filed; 4,036 I-526 Petitions processed
  2. 1,533 I-829 Petitions filed; 340 I-829 Petitions processed
  3. 170 I-924 Petitions filed; 135 I-924 Petitions processed

An excellent webinar took place on April 16, 2015 in response to EB-5 diligence [Kurt Reuss]. Kurt puts on an outstanding series of webinars that take place every other week and deal primarily with serious issues involving the EB-5 program. He tends to have an exceptional panel of speakers, and I was very privileged to be on the panel along with John Tishler of Sheppard Mullin, Robert Divine of Baker Donelson, Carolyn Lee of Miller Mayor and Rupy Cheema of EB 5 Diligence.

As reported by a recent article in Time Magazine, “The Big Test for Chinese Students,” the total number of Chinese students in the U.S. reached more than 270,000 in 2013-14, up 16.5% year on year. Chinese students now account for 31% of foreign students in the U.S. – the largest group by far. Even China’s President Xi Jinping’s daughter attended Harvard. A broader applicant pool gives admissions officers more choice and schools more diversity. And international students tend to pay higher tuition than their American counterparts. Chinese students in U.S.

In a WorldCity article by Ken Roberts, the future of PortMiami is considered while looking at its past milestones. According to Roberts, PortMiami is looking to have significantly increased container traffic after a series of costly infrastructure projects. It will be the first seaport from Miami to Norfolk, Virginia for ships to traverse the expanded Panama Canal. China is already being noted as the top trade partner.

As a follow-up to my recent March 2015 trip to China, I have several observations concerning the status of the EB-5 program and, in particular, the reaction in China with respect to same.

The good news is that the market in China still seems very robust, even with retrogression estimated to take place in May or June. There seems to be a tremendous demand for the EB-5 green card program, notwithstanding the fact that the Chinese nationals are also migrating to other countries around the world that have a much easier entry policy than the United States.
