Symphony Bronzeville Park, LLC, 2022 IL 126511, that the exclusivity provisions of the Illinois Workers’ Compensation Act (the “Compensation Act”) do not preempt a claim for statutory damages under the Illinois Biometric Information Privacy Act (“BIPA”). On February 1, 2022, the U.S. Department of Justice (DOJ) released its enforcement statistics for fiscal year 2021 ( here ). The DOJ obtained over $5.6 billion in False Claims Act (FCA) recoveries in the fiscal year ending September 30, 2021. This is the second-highest annual FCA recovery since 2014 when the DOJ secured $6.2 billion. On January 24, the Federal Trade Commission (FTC) announced its annual update to the Hart-Scott-Rodino (HSR) filing thresholds. The new thresholds were published in the Federal Register on January 24 and will take effect 30 days after publication.
