Marijuana, Hemp, and CBD: Navigating the Complex Federal, State & Local Landscapes

Jonathan Havens, co-chair of both the Firm's Cannabis Law Practice and its Food, Beverage, and Agribusiness Practice, provides an update on the current CBD policy and regulatory landscapes and how they might change in 2021.

Learning objectives:

  1. Identify how the FDA, FTC, and other federal and state government agencies are regulating hemp/hemp-derived CBD products;
  2. Examine FDA's approach to CBD and understanding what action, if any, that the FDA may take near term and long term;
  3. Comprehend how federal and state legislative efforts could impact FDA's role in the space;
  4. Recognize the importance of CBD sourcing, labeling, and testing;
  5. Differentiate between hemp and marijuana, and ensure compliance with federal and state controlled substance laws; and
  6. Understand how regulators will approach new product trends (e.g., Delta-8 THC).
