Ethical Considerations Regarding Outsourcing of Legal Services

William C. Baton, a partner in the Commercial Litigation Practice, spoke about the ethical considerations of outsourcing legal services during a CLE in the firm’s Newark, NJ office.

In his presentation, Bill said in-house counsel and private practitioners may benefit by outsourcing certain legal services, but cautioned to take care not to violate their ethical obligations, especially those owed to clients. The CLE covered  the following topics:

  • Trends and types of legal services outsourcing.
  • Certain guidelines and considerations aimed at maintaining the outsourcing lawyer’s ethical responsibilities regarding confidentiality of information, the attorney-client privilege, conflicts of interest, fees and avoiding the unauthorized practice of law.
