Fiduciary Liability and the Affordable Care Act: Coverage and Compliance

Paul Hummer, a partner in Saul Ewing’s  Insurance and Commercial Litigation practices, and Sarah “Sally” Church, chair of the Employee Benefits and Executive Compensation Practice, will speak at this  seminar sponsored by The Graham Company.

 

The seminar aims to help fiduciaries of employer-provided pension, health and wellness benefit plans under ERISA as well as human resources administrators understand how the 2015 employer mandates required under the Affordable Care Act (ACA) intersect with ERISA and ACA compliance issues and add to the  liability that the fiduciaries face.

Topics will include:

  • Basic concepts of fiduciary liability;
  • Recent case law and insurance developments; and
  • Clarification of  the 2015 Pay or Play mandate, including qualifications for being an applicable employer and determining full-time status.
