James Rohlfing to Present CLE Webcast for the Illinois State Bar Association - "Illinois Makes General Contractors Liable for Paying Subcontractors’ Workers – NOW WHAT?"

Event Dates: September 1, 2022
Industries: Construction

James Rohlfing, a partner in SEA&L's Construction Practice, will present a CLE webcast for the Illinois State Bar Association on September 1, 2022.  The topic will be "Illinois Makes General Contractors Liable for Paying Subcontractors’ Workers – NOW WHAT?"

Public Act 102-1076, which was signed by Gov. JB Pritzker and went into effect on July 1, 2022, makes a prime contractor personally liable for unpaid lower tier wages and other employee benefits, gives a variety of remedies to unpaid employees against their employer (and, now, against prime contractors), and obligates subcontractors to indemnify general contractors under some circumstances. The Act significantly impacts the risks of general contractors and subcontractors engaged in building projects in Illinois. Construction law attorneys, real estate lawyers, workers’ compensation practitioners, and employment law counsel with advanced levels of practice experience who attend this online seminar, will better understand:

  • What the law intended to accomplish;
  • What the language of the new law provides, including the exemptions and how to interpret its uncertain wording;
  • The role surety bonds and other forms of security play in protecting general contractors and higher tier subcontractors from liability under the Act;
  • How general contractors will be impacted by the Act;
  • How to safeguard against liability for unpaid subcontractor wages;
  • How the new law will impact minority and women hiring; and
  • Much more.
