New Developments in Church Plan Litigation

Jim Keller, Co-Chair of Saul Ewing’s Higher Education Practice, served as a member of the faculty for this seminar on new developments in church plan litigation. ERISA provides federal protections for all private-sector pension plans except those established and maintained by churches for their own employees. Jim’s panel reviewed the so-called “Church Plan Exemption” and litigation that has resulted from it.  Some of the topics included assessing recent actions brought against church plans; successes and failures of such litigation; nuances regarding same sex marriage, contraception, and social conscious investment decision-making; and potential Congressional action on the exemption.
