The Illinois Condominium Property Act 2022
Industries Condominium and Community Associations
Saul Ewing Arnstein & Lehr’s Condominium and Community Associations Practice is pleased to once again offer its annual summary of the Illinois Condominium Property Act ("ICPA"). 2020 and 2021 were years that no one will soon forget, with condominium associations scrambling to ensure resident safety in the midst of a global pandemic. Not surprisingly, the legislature made no changes to the Illinois Condominium Property Act (“ICPA”) in 2020 and only one change in 2021 (which allows associations to amend their declarations to require that a majority of their board members live on-site)...

Delaware Enacts PFAS Legislation
Services Environmental
Delaware has taken the initial steps to start addressing PFAS contamination in its drinking water. Like the federal government, the First State is preparing to issue regulations to limit so-called “forever chemicals,” which have been linked to health concerns including cancer. What You Need to Know: Delaware has enacted a law to begin the process, at the state level, to address PFAS contamination in drinking water. The law contemplates establishment of state-level maximum contaminant levels (“MCLs”) for PFAS, which includes PFOA and PFOS. By January 1, 2022, DNREC is required to provide...

Federal Court Blocks Federal Contractor Mandatory Vaccination Rule From Taking Effect
Industries Government Contracts
Services Labor and Employment
On Tuesday, December 7, 2021, a federal judge in Georgia issued a nationwide preliminary injunction halting the enforcement of the federal mandate that obligates many federal contractors and subcontractors to require their employees to be fully vaccinated against COVID-19. As discussed in a previous Alert , the federal contractor vaccine requirement stems from the Executive Order 14024 (“EO 14204”), requiring the creation of a Federal Acquisition Regulation (“FAR”) contract clause mandating that covered contractor employees be fully vaccinated. As a result of this court action, the mandate,...

DOL Finalizes Regulations Increasing Minimum Wage for Federal Contractor Employees
Industries Government Contracts
Services Labor and Employment
The Department of Labor (“DOL”) issued Final Regulations increasing the minimum wage for employees of Federal Government contractors from $10.95 an hour to $15 an hour. The Final Regulations are substantially similar to the proposed rule, which we discussed in our July 2021 Alert . What You Need to Know: The increased wage rate is effective for solicitations issued and contracts awarded after January 30, 2022. The increased wage rate applies to work performed or in connection with Federal contracts. The regulations phase out the tipped minimum wage eliminating it entirely by 2024. The...

Industries Health Care
On November 30, 2021, the United States Department of Health and Human Services (HHS), Office for Civil Rights (OCR) announced its five actions – four settlements and corrective action plans, and one civil money penalty in the amount of $100,000 – under its HIPAA Right of Access Initiative. This announcement is a continuation of OCR’s efforts to ensure individuals can access their health records in a timely manner – within 30 days of a request – and at a reasonable cost under the HIPAA Privacy Rule. The Friday Five: Five Current ERISA Litigation Highlights - December 2021
Services Employee Benefits and ERISA Litigation
This month’s Friday Five discusses cases that focus on what information properly constitutes the administrative record before the court on which a decision must be based. One case explores the ERISA Records Rule which limits an insurer’s ability to supplement the administrative record, and another case explores whether a claimant can obtain a “full and fair review” if she is precluded from reviewing and commenting on the results of an IME. Other cases examine the potential for non-ERISA claims where a claimant questions the existence of a plan, exhaustion of administrative remedies, and...

Non-Displacement of Federal Government Contractor Employees is Back
Industries Government Contracts
Services Labor and Employment
President Biden recently issued an Executive Order titled Executive Order on Nondisplacement of Qualified Workers Under Service Contract s (“EO”). The EO reinstates the requirement first introduced by President Obama, and later revoked by the Trump Administration, directing Federal Agencies to include a clause in Federal Government service contracts requiring the follow-on contractor to offer predecessor contractor employees the right of first refusal to continue in their jobs. A “service contract” includes any contract or subcontract for services covered by the Service Contract Act of 1965,...
