Bockis quoted on Consol Ruling impact on future permit decisions
Andrew Bockis, a partner in the firm’s Environment and Natural Resources Practice, is quoted in this article in Law 360 on how the Pennsylvania Environmental Hearing Board’s decision to throw out a permit issued to Consol Energy Inc. could impact future permitting decisions.
“The Environmental Hearing Board had fashioned a sensible, if nebulous, test in applying the requirements of the amendment to the context of permitting. Going forward, the state’s Department of Environmental Protection must weigh the environmental effects of any decision and consider whether the decision is likely to cause the unreasonable degradation or deterioration of the environment,” Andrew said in the article. “The board observed that such degradation or deterioration could be caused by impacts that are potentially outside the department’s traditional statutory and regulatory jurisdiction.”
