In the article, Joel explains the ruling in Pennsylvania Environmental Defense Foundation v. Commonwealth of Pennsylvania. According to the article, the court found that legislators had violated their responsibilities as trustees of public natural resources under the Pennsylvania Constitution by transferring revenue from the leasing of state forestland for natural gas drilling out of an account reserved for conservation activities.

“I don’t think we can understate the importance of the ruling,” Joel said in the article. “What the Supreme Court did in this case was to completely rewrite Pennsylvania constitutional law with respect to the Environmental Rights Amendment.”
