Reiss quoted on potential wide-ranging impact Cell Therapeutics v. Lash Group decision could have on healthcare market

John B. Reiss, a partner in the Health Law Practice Group, was quoted extensively in this article in the May 3, 2010 issue of The Gray Sheet. Reiss discusses the case of Cell Therapeutics v. Lash Group, in which a decision is expected later this year in a U.S. district court trial. The Ninth Circuit Court of Appeals, which reversed a trial court decision, held that healthcare product manufacturers and stakeholders may be able to sue consultants for decisions they made based on poor advice. If this decision is upheld, healthcare manufacturers, providers and patients may stand to benefit. In addition, it may improve patient care since it would oblige companies and physicians to provide better justification for an off-label use of medication, and would make consulting firms more conservative in how they interpret the law and in their recommendations for clients.
