What Does Justice Kennedy’s Retirement Mean for Higher Education?

Josh Richards, Vice Chair of the Higher Education Practice, is quoted in this article by The Chronicle of Higher Education discussing the retirement of U.S. Supreme Court Justice Anthony Kennedy. According to Josh, the impact of Justice Kennedy's retirement on the higher education industry is still unknown.

"I think that it really depends on what the new court’s agenda is," said Josh. "If the justices, with a new conservative majority, think they have a mandate to start reserving precedent, they may do so."

In reference to a 2016 Justice Kennedy decision that gave institutions the autonomy to make policies about race as a factor in admissions, Josh said, "institutions had an ally in Kennedy."
