Richards Comments on Kisor v. Wilkie in U.S. News & World Report
Josh Richards, vice chair of the Firm’s Higher Education Practice, is quoted in the U.S. News & World Report discussing the recent Supreme Court case Kisor v. Wilkie. According to the article, the case will ask justices to decide whether or not to uphold the Auer decision.
"The tricky thing about figuring out implications for Auer deference going forward in the context of the Education Department is that you have to take into account what the policy objectives are of the agency and how those policy objectives apply to the interpretation of ambiguous regulations," said Josh.
