Tremblay and Havens Quoted on Cannabis Legalization and Employee Drug Testing
With more states decriminalizing or legalizing marijuana use, routine workplace drug screening is coming into question. Jason Tremblay, a partner in the Firm's Labor and Employment Practice, and Jonathan Havens, chair of the Firm's Food and Beverage Practice and co-chair of its Cannabis Law Practice, are quoted in this Law.com article to discuss the topic.
Jason advised that clients "reexamine their current drug screening policies."
According to Jonathan, some employers are making changes to drug testing policies in lieu of completely eradicating them.
"One trend we are seeing is that employers are not getting rid of drug testing completely, but they’re rethinking the frequency with which they test and/or the amount of time between testing," said Jonathan.
