New Jersey "Ban the Box" Goes Into Effect March 1, 2015
On March 1, 2015, New Jersey’s “Ban the Box” law goes into effect. New Jersey employers should ensure that their employment applications do not include a box to mark or a question concerning an applicant’s criminal history on a job application, or post job advertisements stating that they will not consider applicants with a criminal record. Doing so will run afoul of the new law. Further, as of March 1, 2015, covered employers cannot orally ask job applicants about their criminal histories or perform a criminal background check during the “initial employment application process.” After the initial employment application process employers may obtain information about the applicant’s criminal record.
