Saul Ewing Partner Joel R. Burcat, Chair of the Environment and Natural Resources Practice Group in the Harrisburg office, wrote this article about a recent decision by the U.S. Ninth Circuit Court of Appeals that could spark an increase in regulatory takings litigation.

In the article, Mr. Burcat discusses the ramifications of the U.S. Ninth Circuit Court of Appeals decision to apply a rarely-used legal test derived from the U.S. Supreme Court ruling in Agins v. City of Tiburon, 447 U.S. 255 (1980).
