Commonwealth Court analyzes driver's disability claim under PHRA

Carolyn discusses an opinion issued by the Pennsylvania Commonwealth Court on February 2 that addresses the disability discrimination claims under the Pennsylvania Human Relations Act. “While each situation is unique, the court’s decision in Lazer Spot reinforces the steps you should follow when an employee provides notice of a disability,” wrote Carolyn. “In particular, you should consider the specific life activity he claims his disability substantially limits, assess the essential functions of his job, and communicate with him to determine whether a reasonable accommodation would allow him to perform those essential functions.”
