Empowerment Act Provision Permitting Waiver of the Multiple-Prime Contractor Mandate Set to Expire at the End of June 2010

William W. Warren, Jr., partner in the Business and Finance Department and a member of the Construction Practice Group, writes in this article about the implications for school districts if the Education Empowerment Act of 2000 is not re-enacted after it expires at the end of June 2010.

While Mr. Warren urges school districts to submit waiver applications early, particularly for waiver of the multiple-prime requirement, he also encourages school district officials to weigh the pros and cons of getting a waiver for projects.

"Opting for single-prime construction using the mandate waiver process will not always work to the advantage of a school district in many situations around the Commonwealth," he concludes.
