Growing Medical Marijuana Issues in The Workplace
Dena Calo and Gillian Cooper, members of the Firm’s Food and Beverage and Labor and Employment Practices, authored this article on medical marijuana use for the Delaware Restaurant Association’s quarterly publication. The article explains the challenges employers face when making decisions about employee marijuana use due to the fact that state and federal laws and company policies surrounding the issue may not align. Specifically, the article highlights that under the Americans with Disabilities Act, employers may be required to provide reasonable accommodations for medical marijuana users. The authors conclude the article by encouraging employers to review their employee policies and confirm compliance with state laws.
