Proposed Federal Legislation Poses Possible Challenges For Businesses

Catherine E. Walters, a Partner, and Emily H. Damron an Associate, all of the Labor, Employment and Employee Benefits Practice Group, wrote this article that gives employers an overview of what they can expect in coming months as a result of the election of President Barack Obama.

The article, which is the first of two, focuses principally on the anticipated passage of the Employee Free Choice Act (EFCA), which will make it easier for employees to unionize. The article also covers probable passage of the Re-Empowerment of Skilled and Professional Employees and Construction Tradworkers (Respect) Act, which would narrow the definition of who qualifies as a supervisor, and The Patriot Employers Act, which would provide a tax credit to employers who meet a number of requirements.
