Social Media Policies Facing Increased NLRB Scrutiny
Heather R. Pruger, an associate in the Labor, Employment and Employee Benefits Practice, wrote this article that appeared in the "Tech Corner" section of the ABA’sFlash newsletter. The article discusses the aggressive actions that the National Labor Relations Board (NLRB) has taken in pursuing employers on the basis of their social media policies under Section 7 of the National Labor Relations Act. The NLRB recently applied Section 7 to interactive discussions between employees on social media, comparing social media discussions to traditional "break room" discussions among employees.
