Life Sciences & IP Litigation

Saul Ewing Arnstein & Lehr attorneys understand the risks you face when your IP and brand are threatened, and we have deep experience helping clients protect them when disputes escalate into litigation. Our attorneys handle a variety of intellectual property litigation cases that involve patents, copyrights, trademarks, unfair competition and trade secrets. We represent clients in federal courts throughout the United States, with significant bench and jury trial experience. We also handle matters in appellate courts, in front of the Patent Trial and Appeal Board (PTAB) and the Trademark Trial and Appeal Board (TTAB), and in alternative dispute resolution forums. In addition, we advise clients on ICANN domain name disputes before the National Arbitration Forum (NAF) and World Intellectual Property Organization (WIPO).

Strength in the Life Sciences Industry

Protecting IP is paramount to the success of pharmaceutical companies. Our team includes attorneys who serve as New Jersey and Delaware litigation counsel in complex, high-profile patent cases for more than two dozen pharmaceutical and medical device companies. We have secured major trial victories in ANDA (Abbreviated New Drug Application) cases where billions of dollars in sales were at stake, including a case heard in the U.S. Supreme Court. Our attorneys also advocate for clients at emergent proceedings for restraining orders and injunctions and enforce and defend IP rights pursuant to confidentiality agreements. Our patent litigation team has been recognized nationally as one of the top five "Go-To" law firms for patent litigation in a report by Lex Machina, and has continuously been ranked fourth, nationally, for the number of cases filed on behalf of patentees, and on behalf of ANDA plaintiffs.

Strength in IP Litigation Across Industries

Our IP litigators are well-versed in a broad range of technologies, representing clients in the life sciences, software, microelectronics, semiconductors, wireless communications, industrial, consumer products, automotive, agriculture and construction industries. With a deep understanding of our client’s technologies and innovations, our IP litigation teams are adept at translating complex technical subject matter for a lay audience, and especially judges. Our IP litigators also have extensive experience protecting our clients' IP, including trademark, trade dress, false advertising, and copyright, as well as defending against IP-related claims. Our IP litigators are skilled in both defending and enforcing intellectual property lawsuits and winning cases through pretrial motions, bench and jury trial victories, and successful appeals.
