Matt Haar draws on more than 20 years of experience as a litigator to handle corporate and commercial disputes, including cases involving insurance and reinsurance, energy and permitting, and clean energy. Beyond this industry-specific work, Matt represents companies across an array of industries, including real estate, government contracts and cannabis, in litigation in state, and federal trial and appeals courts, as well as before administrative bodies in Pennsylvania and throughout the country. His experience includes cases involving fraud, misrepresentation and negligence. He also handles disputes among owners and key employees of closely held businesses, including cases requiring arbitration and involving business break-ups. He also handles bid protests, challenges to licensing procedures, title insurance claims and statutory violations, including the Uniform Trade Practices and Consumer Protection Law and the Real Estate Sellers Disclosure Law.

Insurance companies rely on Matt to represent them in coverage and contractual litigation, antitrust matters, rehabilitations and liquidations, and bad faith actions. The depth and breadth of Matt’s understanding of bad faith issues in particular is reflected in his work on a comprehensive 50-state survey, "Insurance Bad Faith: A Compendium of State Law." Published by DRI Defense Library Series (4th. Ed 2015), Matt is the co-author and regional editor of this survey. Matt also routinely handles extra-contractual liability cases for other clients in the financial services industry such as real estate agents and brokers, banks, trusts, producers and credit card companies.

Beyond his commercial litigation and insurance work, Matt litigates disputes related to exploration, production and transportation of oil and natural gas, in state and federal courts as well as Pennsylvania state administrative agencies. He also handles matters for clean energy companies.

Additionally, Matt has been an adjunct professor at Pennsylvania State University's Dickinson School of Law where he teaches courses on problem solving.

Experience

Commercial Litigation

Select representations include:

A real estate brokerage company and one of its agents in a lawsuit connected with the sale of a farmstead in Pennsylvania in which the client represented the sellers in the transaction. The buyers sued the brokerage and agent, as well as the buyers’ broker and agent, alleging non-disclosure of restrictive covenants. The buyers claimed fraud, misrepresentation, negligence, and statutory violations of the Uniform Trade Practices and Consumer Protection Law and the Real Estate Sellers Disclosure Law. The case ended with a favorable settlement for the client on the fourth day of a jury trial.
A contractor in an appeal in the Commonwealth Court of Pennsylvania, which ruled that the denial of a bid protest by the Pennsylvania Department of Human Services was arbitrary and capricious.
A cannabis grower/processor in Pennsylvania in an administrative challenge to the state’s recently issued medical marijuana licenses. An applicant who failed to secure a license filed a lawsuit in Pennsylvania Commonwealth Court that sought to enjoin the Pennsylvania Department of Health (DOH) and successful licensees, including the client, from moving forward with the state’s medical marijuana program. The Commonwealth Court ruled in favor of the client, DOH and the other successful licensees, throwing out the challenge.
Insurance Litigation

Select representations include:

A health care company in the dismissal of a lawsuit by a policyholder related to denied claims for out-of-network medical services. The policyholder attempted to state claims for unfair trade practices and consumer protection law violations, insurance bad faith, and fraudulent misrepresentation. In addition to reimbursement of unpaid claims, the policyholder sought treble damages, punitive damages and attorney’s fees. The district court judge dismissed all claims against the client.
A national insurance company in a multi-billion dollar dispute involving regulatory issues related to the reserves and surplus accumulated by the insurer’s plans.
A title insurance company in a favorable decision in the Pennsylvania Supreme Court on title insurance coverage and insurance bad faith claims.
A life and supplemental health insurer in a coverage dispute.
