Brandon Brauer will speak as a panelist at the National ABA RPTE Conference on May 1, 2025, in Las Vegas, Nevada. The title of the session is "Betting on Success: Title and Survey Coverage for Commercial Construction Projects."
This panel presentation will focus on common title and survey issues in commercial development and construction loan financing transactions. The panel will provide an overview of mechanics lien rights and the differing priority positions under state law that affect available mechanics lien coverage in title insurance policies. The panel will discuss mechanics lien coverage under the loan policy, incremental mechanics lien coverage under the ALTA 32/33 series endorsements, survey coverage in the title policy for new construction, and the land under development title endorsements that are available to the insured lender and developer/owner in a commercial construction project, including title company requirements to obtain this coverage. Title insurance counsel, lender's counsel, and developer's counsel will also share practical strategies for managing lien risk and preventing lien claims from jeopardizing project financing.
