This presentation will review considerations for navigating cooperation incentives in light of the latest iteration of the U.S. Department of Justice’s Corporate Enforcement Policy, the potential benefits and risks of disclosure, and the implications for traditional “proffers” to government lawyers and agents, which are a prominent aspect of white collar defense practice. The session will be guided by experienced in-house counsel and white collar defense counsel with federal prosecution experience.
