Marking requirements across types of intellectual property can vary as much as requirements for obtaining and maintaining patents, trademarks, and copyrights. Although notice may not be required, it can be a prerequisite for obtaining damages in the United States. Moreover, foreign marking requirements can conflict with US requirements, IP portfolios are constantly evolving, and marking can be the classic Quadrant 2 (Important but not Urgent) matter—until years of potential damages are in peril. This program will provide practical advice on topics including patent marking as a prerequisite to obtaining pre-suit damages and when, how, and when not to use the (R), TM, (C) and (P) symbols for trademarks and copyrights.
