Structuring Options and Considerations for Latin Americans Investing in U.S. Real Estate Including Real Estate Funds
This panel will analyze various options for structuring U.S.-Latin American cross-border real estate investments. Among other things, we will address special considerations relating to hospitality investments, including issues arising from the rise of vacation and short-term rental apps. We will consider structures to address FIRPTA and other withholding regimes, and we will consider challenges arising from various forms of anti-avoidance legislation, including CFC provisions, GAARs, substantiality requirements for holding companies, and other limitations on treaty relief. We also will analyze the potential investment impact of new legislation and legislative proposals.
