Caitlin represents insurance companies and insurance brokers, including a large international insurance broker, in coverage-related disputes and claims of professional malfeasance. She also represents insureds, including food manufacturers, on covered claims involving D&O and CGL policies.

  • Defend insurance broker in professional malpractice suit by client involving analysis of coverage afforded by yacht policy.

Employee Benefits/ERISA Litigation

Caitlin has managed coverage disputes involving group employee disability policies nationwide. Her experience includes defense of over 100 group and individual life, health and disability cases (both ERISA and non-ERISA) for the country's leading insurers. Caitlin has particular experience defending these cases in the Third Circuit and federal courts therein. Caitlin co-edits Saul Ewing’s monthly Friday Five which keeps the industry apprised of developments in ERISA litigation.

  • Argued motion for summary judgment in federal court on interpretation of group disability policy.
  • Secured dismissal of lawsuit against insurer concerning implementation of group life insurance policy.
  • Lead defense counsel for insurer in ERISA class action involving life insurance policies claims practices.

Real Estate Litigation

Residential and commercial real estate transactions, particularly with first-time buyers or sellers can result in litigation risk for real estate brokers and agents. Caitlin has successfully defended and obtained dismissal of these cases. Caitlin has also secured injunctions and recovery for title insurance companies in cases involving title agent defalcations and represented insureds in title insurance claims.

  • Obtain judgment for real estate broker in claim stemming from commercial real estate transaction and obtaining favorable judgment awarding attorney's fee for frivolous litigation.
  • Represent title insurer in multimillion dollar defalcation by title agent securing injunction for insurer.
  • Represent commercial real estate services firm in premises liability dispute involving breach of contract and securing favorable opinion from Third Circuit.

Employment & Restrictive Covenant Litigation

Caitlin has represented employers in a variety of employment litigation matters with a particular emphasis on non-compete agreements and employee raiding claims for the financial services and insurance industries.

  • Represent employer in suit against executive officer for breach of forfeiture for competition provision in severance agreement.
  • Defend financial services firms in multi-week Financial Industry Regulatory Authority (FINRA) arbitrations brought by competitors alleging employee raiding, unfair competition, misappropriation of trade secrets, breach of fiduciary duty and civil conspiracy.
  • Represent employer in employment contract dispute against former CEO, defeat summary judgment for employee and obtain summary judgment for employer as the non-moving party
