Overview

James Chou is a litigator and trial lawyer with nearly three decades of experience representing clients in commercial and business litigation matters. Clients including hedge funds, private equity firms, independent investment banks, insurance carriers, manufacturers and distributors of consumer products, food and beverage companies, and high net worth individuals rely on James to handle cases in state and federal courts and other venues. Some of his key experience includes:

  • Breach of contract, fraud and breach of fiduciary duty claims.
  • Cases involving misappropriation of trade secrets, breach of restrictive covenants and corporate espionage.
  • Corporate governance disputes.
  • Partnership disputes.

Beyond his work in the courtroom, James draws on this broad litigation experience to act as outside general counsel to middle market, privately held companies in need of assistance with navigating complex legal issues and requirements.

James also handles bankruptcy-related litigation primarily on behalf of formal and ad hoc creditor and bondholder committees in chapter 11 cases.  His experience includes valuation disputes, federal and state law fraudulent conveyance claims, preference claims, challenges to involuntary petitions, and post-emergence litigation. More recently, he has represented individual defendants in adversary proceedings alleging fraud, civil RICO, and breach of fiduciary duty claims.

In addition to his litigation practice, James has served as a court-appointed special referee who adjudicates discovery disputes and other specific matters and is certified as a court-appointed receiver by the New York State Office of Court Administration.
