Government Contracting

Select government contracting matters include:

  • Negotiated numerous contracts, subcontracts, and supplier agreements to support overseas contingency operations, often on short notice, to meet joint urgent operational needs.
  • Developed and implemented government contractor compliance programs.
  • Successfully litigated and resolved cases in federal and state courts before boards of contract appeals and litigated bid protests before the Government Accountability Office and at the state level.
  • Led a successful effort to lift a company’s suspension from government contracting and developed a negotiation strategy for the successful release of funds withheld from client that were critical to ongoing operations.
  • Developed a strategy to successfully mitigate potential organizational conflict of interest in order to avoid the termination of one of the client's largest contracts. 

     

Cybersecurity

Select cybersecurity matters include:

  • Counseled clients on Cybersecurity Maturity Model Certification (CMMC) readiness and compliance and provided guidance on Federal Acquisition Regulation (FAR), Defense Federal Acquisition Regulation Supplement (DFARS), and other cybersecurity requirements. 
  • Managed responses to numerous cybersecurity incidents, data privacy incidents, and security incidents, including incidents arising out of attacks by Nation-State sponsored adversaries and insider threats.
  • Initiated and conducted a multi-year civil and criminal False Claims Act (FCA) investigation ultimately leading to a $31 million settlement and also handled numerous other FCA investigations including those involving alleged cybersecurity fraud, time charging, labor category mapping, ethics, and procurement integrity.
  • Served as a general attorney for the launch of a new cybersecurity business providing and coordinating legal support, negotiated significant transactions including a software license enabling the business and large sales of cyber products, and supported the ultimate divestiture of the company to a private equity investor for a significant return on investment.
