Select representations include:

  • A company in five matters arising from alleged violations of the Fair Credit Reporting Act and specifically, a furnisher’s obligation to undertake a reasonable investigation of a dispute received from the credit reporting agencies. All five cases in U.S. District Courts for the Eastern and Southern Districts of New York have been resolved.
  • A title insurance company that issued a policy to the lender in a lawsuit arising out of the abstract company’s failure to record a mortgage satisfaction for the second mortgage at the time of the refinancing of the then-current first mortgage. On a motion to dismiss, the New York Supreme Court dismissed the claims for failure to state a claim.
  • A corporation in a shareholder litigation matter arising out of alleged disclosure deficiencies in the corporations’ proxy statement, which sought stockholder approval of several proposals, including an amendment to two of its compensation plans. After filing a pre-motion conference request seeking the court’s permission to move to dismiss the complaint, plaintiff voluntarily dismissed the complaint.
  • A payment systems company in a putative class action that arose out of the alleged failure to disclose a credit/debit card surcharge associated with the purchases made at vending machines. During a pre-motion conference, the Southern District of New York judge directed the plaintiff to voluntarily dismiss his claims in lieu of a formal motion to dismiss.
  • One of the largest telecommunications providers in numerous litigations in New York involving property damage and rights.
