Commercial Litigation

 

  • Represented a company in five different matters arising from alleged violations of the Fair Credit Reporting Act and specifically, a furnisher’s obligation to undertake a reasonable investigation of a dispute received from the credit reporting agencies. All five cases in U.S. District Courts for the Eastern and Southern Districts of New York have been resolved.
  • Represented a corporation in a shareholder litigation matter arising out of alleged disclosure deficiencies in the corporations’ proxy statement, which sought stockholder approval of several proposals, including an amendment to two of its compensation plans. After filing a pre-motion conference request seeking the court’s permission to move to dismiss the complaint, plaintiff voluntarily dismissed the complaint.
  • Represented one of the largest telecommunications providers in numerous litigations in New York involving property damage.
  • Obtained a dismissal in the Southern District of New York of a company in a lawsuit alleging RICO violations from the collection of a purportedly unlawful debt.  

Class Action

  • Obtained a dismissal in the District Court for the Northern District of Ohio of an insurance carrier in a class action challenging the validity of a system used to value auto claims. 
  • Represented a payment systems company in a putative class action that arose out of the alleged failure to disclose a credit/debit card surcharge associated with the purchases made at vending machines. During a pre-motion conference, the Southern District of New York judge directed the plaintiff to voluntarily dismiss his claims in lieu of a formal motion to dismiss.
     

Insurance Litigation

  • Obtained a dismissal in New York Supreme Court of a title insurance company that issued a policy to the lender in a lawsuit arising out of the abstract company’s failure to record a mortgage satisfaction for the second mortgage at the time of the refinancing of the then-current first mortgage. 
  • Represented a reinsurance company in an arbitration for breach of Quota Share Agreements.
  • Obtained summary judgment, which was unanimously affirmed by New York’s Appellate Division, on behalf of a life insurance company in a lawsuit arising from the lapse of a life insurance policy.  
  • Obtained a voluntary dismissal with prejudice of three related insurance companies in a lawsuit arising out of the alleged failure to pay the full supplemental death benefit under a group life insurance policy.
