Employment Litigation

  • Won a complete affirmance by the New Jersey Appellate Division of a trial court order dismissing a discrimination lawsuit and compelling arbitration. The Appellate Division’s decision was the second in the state finding that a recent amendment to the New Jersey Law Against Discrimination barring arbitration of certain claims was preempted by the Federal Arbitration Act.
  • Won a motion to dismiss in federal court on behalf of a large fast-casual dining franchisee and franchisor against claims of racial discrimination raised by a customer, avoiding discovery and demands for injunctive relief premised upon the clients’ customer-relations policies.
  • Defeated administrative claims of national origin discrimination pursued by a former employee against a restaurant owner before the New York State Division of Human Rights.

Restrictive Covenants Litigation

  • Represented a multinational advisory and insurance brokerage firm in various litigations to enforce restrictive covenants against departing brokers by way of a temporary restraining order and preliminary injunctive relief.
  • Obtained an immediate temporary injunction followed by a permanent injunction on behalf of a Fortune-500 financial services firm against a departing employee accused of soliciting clients in violation of the defendant’s restrictive covenants.
  • Part of a cross-border litigation team that obtained a complete dismissal of a lawsuit raised by a departing executive in the federal court in Puerto Rico seeking to invalidate his restrictive covenants under local law. The court found that the subject-agreements were governed under Florida law and dismissed the action for declaratory judgment.
  • Obtained a successful arbitration ruling on behalf of a group of physicians seeking to invalidate and reform their restrictive covenants with their former employer.
