Francelina Perdomo Klukosky represents individuals and corporate creators in protecting their intellectual property assets and assisting with their business transactions and litigation. Drawing on more than two decades of legal experience and her personal passion for technology and innovation and the arts, Fran approaches her work with IP and business deals as if she is in-house counsel working "out of the house." As a fluent Spanish speaker and a lawyer with a legal education from universities in the United States, France and the Dominican Republic, Fran is also well equipped to advise on IP asset protection, complex licensing and other transactions involving the sale and distribution of goods across the borders of the United States, Latin America and Europe.

Fran's work in intellectual property spans from trademarks and copyrights to patents and trade secrets. To help clients effectively protect, monetize and enforce their IP assets, she drafts opinion letters, contracts, and develops strategies to minimize the risk of litigation in all these areas. Her trademark work also includes prosecution and enforcement, portfolio management and strategy, licensing, co-branding and joint ventures, as well as brand ambassador, influencer and endorsements contracts. She also has experience with drafting, reviewing, and negotiating agreements in the talent, influencer, brand partnership and sponsorship space.

Emerging and developing companies, including start-ups in particular, rely on Fran to create cost-effective strategies that protect their IP asset in the commercial marketplace and position them to avoid litigation when possible and pursue and defend claims when necessary. Her experience includes developing master agreements among collaborators, including joint ventures. She also advises on name, image and likeness (NILs) licensing and event production work.


If a dispute leads to litigation, Fran represents these clients, along with well-established artists and corporate entities, in complex intellectual property and commercial claims involving intellectual property. Her experience includes matters involving breach of contract, cross-border transactions, and the arts and entertainment, in state and federal court in New York, across the country and in Latin America. Fran also handles matters before the Trademark Trial and Appeal Board (TTAB).
