Employment Litigation
Select representations include:
- Four individual management defendants in litigation in which the plaintiff, a current employee, alleges discrimination and harassment as a result of her gender, national origin, race, color, religion, age, and marital status. Plaintiff alleged whistleblower retaliation under FEHA and Labor Code § 1102.5 for her reporting and protesting the alleged unlawful conduct by the defendants. This high-profile case has received media and local news coverage, and legal advice related to public relations strategies have been utilized. A 20-day jury trial is set in January 2024 in Los Angeles Superior Court.
- An employer in litigation in which three plaintiffs alleged discrimination, wrongful termination, and retaliation for their protective activities relating to U.S. governmental investigations, for reporting suspicious activity, raising concerns, and providing information to and cooperating during the investigation (which culminated in a report revealing their individual wrongdoings.) Discovery in this case was complicated because the investigations were conducted by the U.S. government and an outside law firm, and as such, the extensive investigation and written reports justifying the terminations were protected by the attorney-client privilege and the attorney work-product doctrine. The decision-makers were high-level executives giving rise to apex deposition issues. In addition, there were public relations concerns which involved complex strategies shaped by legal advice. This case was filed in Orange County Superior Court. The case was mediated and settled on favorable terms for the employer.
- A telecommunications company in litigation in which the plaintiff, a former employee, alleged constructive discharge, harassment and discrimination based on gender and disability. The matter is in arbitration before JAMS.
- An employer in a federal court case in which the plaintiff claimed 10 counts of harassment, discrimination, retaliation, and failure to accommodate based on disability. Jessica obtained summary judgment in favor of the client and handled all aspects from the administrative agency appeal through the Ninth Circuit appeal.
Real Estate Litigation
Select representations include:
- Real property owners in a three-week jury trial involving breach of contract, negligence, and inverse condemnation claims. The trial resulted in a verdict/judgment in excess of $1 million, plus attorney’s fees in favor of the client.
- A real estate developer and surety bond company in a one-week bench trial involving a large development project. Published opinion in favor of the client: Nissho of California, Inc. v. Bond Safeguard Insurance Co. (2013) 220 Cal.App.4th 974.
