Steven represents property owners, property managers, developers, lenders, borrowers, title companies, tenants and guarantors in litigation. Steven regularly represents commercial real estate funds in the due diligence, acquisition, and disposition of underperforming or distressed real estate assets, often requiring foreclosure, eviction, appointments of receivers, and pursuit of deficiency judgments. Steven also has appeared before administrative agencies to obtain tax exemptions, including homestead and disability, and to obtain a reduction in tax assessments.

Other select representations include:

  • A real estate developer in a partnership dispute involving a 180-acre undeveloped parcel planned for a large-scale residential complex.
  • A condominium converter and principals in action for fraudulent concealment, resulting in a judgment on their behalf following a bench trial in U.S. Bankruptcy Court.
  • A property owner in an action brought by subsequent owner alleging claims for negligent misrepresentation and nondisclosure.

Construction

Steven has defended part manufacturers, distributors, and suppliers as well as general contractors against claims involving construction defects and negligent installation.  He has also prosecuted and defended against construction lien foreclosure actions.

Other select representations include:

  • A general contractor in a dispute involving alleged shoddy workmanship, the use of unlicensed contractors, and construction delays.
  • A manufacturer and distributor of fire sprinkler products in a dispute alleging failure to warn of incompatibility and installation error.
